About the Office

The Office of General Counsel (OGC) is in-house counsel to the State Bar, providing a full range of services, including representation of the State Bar in all state and federal courts and before administrative agencies; advocacy of State Bar discipline and admission cases in the California Supreme Court; and providing legal advice to the State Bar Board of Trustees, and all State Bar entities, executives, and programmatic clients.

OGC provides legal advice and representation in the following areas: litigation, admissions and discipline, antitrust, Bagley-Keene Open Meeting Act, bankruptcy, California Public Records Act, collections, contracts, copyright, governance, labor and employment, legislation, regulations and rules, real estate, regulatory work, and general corporate matters. Attorneys in OGC are also expected to work on requests for "second-look" of disciplinary complaints that have been closed by Office of Chief Trial Counsel.

About the Position

The State Bar's Complaint Review Unit (CRU) is housed within the Office of General Counsel and provides a second-look review of disciplinary complaints that were closed without the imposition of discipline. CRU is seeking an individual who would like to gain knowledge of the discipline system and experience in the area of professional responsibility and attorney ethics. The position requires substantive review of closed disciplinary case files and the ability to make recommendations for next steps. Attention to detail and strong analytical and writing skills are required.

Definition

The Provisionally Licensed Lawyer (PLL) is a two-year limited-term, at-will position that serves under close supervision of a qualifying supervising attorney. The PLL assists in and performs legal work involving identification of legal issues; recommendations of appropriate action; resolution of requests received and reviewed by Complaint Review Unit, if assigned to Office of General Counsel; interpretation and application of laws, rules, regulations, and other legal authorities; legal research and analysis; preparation of legal memoranda, opinions, correspondence, and other documents; and litigation activities.

Distinguishing Characteristics

A PLL is permitted to engage in nearly all of the same activities that a fully licensed lawyer is permitted to engage in, but they must do so under the supervision of a qualifying supervising attorney, and they are subject to certain conditions. Both the PLL and their supervising attorney are required to abide by all applicable State Bar rules and guidelines. The PLL differs from an Attorney I classification in that the latter has been licensed by the State Bar and can perform their work more independently. Additionally, a PLL must:
